PELIGONI BOOKING SERVICES LTD BOOKING TERMS & CONDITIONS

  1. WHO WE ARE AND OUR AGREEMENT WITH YOU

Peligoni Booking Services Limited (company registered in England and Wales under number 05355583), whose registered office is at Unit 5 The Bull Pen Churchill Heath Farm, Kingham, Chipping Norton, England, OX7 6UJ  (“We” / “Us” / “Our”) is the arranger of Your (“Your” / “You”) Accommodation, Club Membership Packages and any pre-purchased Club Activities subject to these Booking Conditions. Capitalised terms are defined in condition 13.

We act as agent for suppliers of the travel services you book and We will arrange for You to enter into a contract with those suppliers, in accordance with these Booking Conditions.

  1. BOOKING PROCESS

2.1 These Booking Conditions apply to the arrangements You book through Us, namely:

2.1.1 Accommodation;
2.1.2 Club Membership Packages; and
2.1.3 Pre purchased Club Activities.

Any other ‘additional services’ will be arranged separately and shall not be subject to these Booking Conditions.

2.2 Where You ask us to arrange Car Rental, the reservation will be made in Your name, but we do not complete the booking or take any monies for Car Rentals and You will be responsible for this and will complete Your booking with the Car Rental company and be subject to the terms and conditions applicable at the point You make that booking.

2.3 When You book Your arrangements with Us, You guarantee that You have the authority to accept and do accept on behalf of Your party these Booking Conditions, the Accommodation Terms and the Club Membership Terms (which also govern the purchase of Club Activities).

2.4 We are not the supplier of the Accommodation, Club Membership Packages or Club Activities. We are acting as agent for the Property Owner (for Accommodation) and the  Peligoni Club, for Club Membership Packages and Club Activities.

2.5 We will arrange for You to enter into contracts with those suppliers, on their terms and conditions (“Supplier Terms”), which will apply to Your Booking, and which are annexed to these Booking Conditions.

2.6 When We arrange a Booking for Accommodation, Club Membership Packages and/ or Club Activities (either from details provided by You over our website, email or over the telephone), We use the details you have provided to Us, therefore it is important that all the names, addresses and dates for travel that You have provided to Us are correct.

2.7 We shall forward to You a Booking Confirmation with full details of Your Booking and this is when contracts will exist for the package booked and the Supplier Terms will apply. Please check this through thoroughly upon receipt to ensure that these details are correct. Making changes to the particulars of a confirmed Booking following 5 days of receipt of Your Booking Confirmation may incur charges, therefore it is important that You ensure that information provided to Us is correct to avoid any charges.

2.8 Your Booking is for the Accommodation and any Club Memberships and Club Activities set out in Your Booking. Your Booking does not include any flights, transfers, catering or car-hire unless otherwise stated in Your Booking Confirmation.

2.9 Your contract will consist of these Booking Conditions and the description of the package holiday as provided to You at the time of booking, together with the Supplier Terms applicable to the arrangements You have booked. You must have read and accepted these Booking Conditions at the time you make your booking.

2.10 Any special requests made by You at the time of booking are noted and We do our very best to comply with these wherever possible. However, although We do make every effort to meet Your requirements, We cannot unfortunately give a guarantee.

2.11 Please note that information contained on Our website may need updating prior to booking and the description of the package holiday that will be included is the description confirmed to You immediately prior to booking.

2.12 You must also check information about any potential local events that may affect Your enjoyment of Your trip, in Your destination; for example, carnivals, religious festivals, national festivals, holidays or other event that might affect the smooth operation of Your holiday.

  1. PRINCIPAL SUPPLIERS

3.1 Accommodation

3.1.1 Accommodation at the Property specified in Your Booking Confirmation is provided by the Property Owner and is subject to the Accommodation Terms, which are annexed to these Booking Conditions.
3.1.2 You acknowledge that We have brought the Accommodation Terms to Your attention prior to you making Your Booking and you agree to be bound by them.
3.1.2 You acknowledge that pursuant to the Accommodation Terms:

3.1.3.1 The Property will be available to you from 4pm on Your Arrival Date until 10am on Your Departure Date.
3.1.3.2 You are required to check-in at the Peligoni Club and to provide credit card details as part of the check- in process at the Peligoni Club.  This includes the Peligoni Club taking a nominal credit card payment in order to save the credit card details on its merchant service provider’s system and tokenise the card, allowing the Peligoni Club to take further monies if Your bill (in relation to Peligoni Club services used, bar and restaurant spend, etc) is not paid, and to collect a Security Deposit on behalf of the Property Owner, such Security Deposit to be held and applied in accordance with the Accommodation Terms.  The credit card details are not passed to any other third party.
3.1.3.3 You, as the main booking contact, are required at check-in to provide Your passport for copying to comply with local legislation.

3.2 The Peligoni Club

3.2.1 Club Membership Packages and any pre-purchased Club Activities are supplied by The Peligoni Club and are subject to the Club Membership Terms, which are annexed to these Booking Conditions.
3.2.2 You acknowledge that We have brought the Club Membership Terms to Your attention prior to You making Your Booking and you agree to be bound by them.
3.2.3 You acknowledge that pursuant to the Club Membership Terms, if You or any of Your travelling party damages any Peligoni Club equipment or property as a result of Your (or any of Your travelling party’s) inappropriate usage, a failure to comply with the reasonable instructions of Peligoni Club personnel or gross negligence, You will be liable for such damage.

3.3 Where there is any inconsistency between these Booking Conditions and the Supplier Terms, then these Booking Conditions prevail only to the extent of any inconsistency.

  1. PAYMENTS

4.1 We reserve the right to alter the prices of any of the accommodation and club facilities shown in our promotional literature, in accordance with these Booking Conditions and prior to You booking with Us. The current price of the arrangements will be notified to You at the time of booking and before Your contract is confirmed.

4.2 The price for the arrangements that You wish to book is listed in pound sterling, including any applicable VAT, for each booking.

4.3 Prices are shown excluding administrative fees, unless otherwise mentioned on the website. The administrative fees, if applicable, shall be confirmed to You at the time of booking.

4.4 Our packages include all elements of the accommodation and use of club facilities as detailed in the description of the package confirmed to You at the time of booking (subject to this clause 5). If You have any special requests relating to diet, accommodation and so forth, these must be made known at the time of booking. We will do Our best to comply with them but cannot guarantee to do so.

4.5 We draw Your attention to the fact that errors in the information You provide to Us may affect the price of the services being booked. We reserve the right to cancel any booking if changes are required to the services being booked at Your request, including any applicable supplier costs, whether this is due to Your error in providing the information to us, or otherwise in accordance with these Booking Conditions.

4.6 The booking shall be considered accepted, and We will confirm the reservation with the suppliers upon receipt of payment.

4.7 PRICE REVISION BEFORE YOUR DEPARTURE: We can change Your holiday price after You’ve booked, only in certain circumstances. Changes in the price of Your travel arrangements can be made due to changes in: transportation costs (eg, cost of fuel or other power sources); the level of taxes or fees imposed by third parties including tourist taxes, landing taxes or embarkation or disembarkation fees at ports and airports; or exchange rates, mean that the price of Your travel arrangements may change after You have booked. However, there will be no change within 20 days of Your departure. We will absorb, and You will not be charged for, any increase equivalent to 2% of the price of Your travel arrangements, excluding insurance premiums and any amendment charges, will be absorbed by Us. You will be charged for the amount over and above that. If this means that You have to pay an increase of more than 8% of the price of Your travel arrangements, You will have the option of accepting a change to another holiday if We are able to offer one (and We will refund any price difference if the alternative is of a lower value), or cancel and receive a full refund of all moneys paid, except for any amendment charges. Should You decide to cancel You must do so within the time period set out by Us when notifying the price change; (2) We will provide a refund of insurance premiums paid to Us if You can show that You are unable to transfer or reuse Your policy. Whether You cancel or not You will also be entitled, under the terms set out in respect of major changes (Alterations and Cancellations by Us) to accept from Us an offer of alternative travel arrangements if We are able to do so and compensation as set out below.

4.8 Should the price of Your holiday go down due to the changes mentioned above, then any refund due will be paid to You. We will deduct from this refund our administrative expenses incurred.  Please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of Your travel due to contractual and other protection in place.

4.9 Payments for Accommodation, Club Membership Packages and any pre-purchased Club Activities are required to be paid by the due dates set out in the Accommodation Terms and the Club Membership, as confirmed in Your Booking Confirmation.

4.10 If You fail to make a payment by the due date, then You acknowledge that the Property Owner or the Peligoni Club (as the case may be) may treat your booking as cancelled and impose cancellation charges in accordance with the Accommodation Terms or the Club Membership Terms.

  1. AMENDMENTS AND CANCELLATIONS

5.1 If you need to make any amendments to or to cancel Your Booking, please notify Us by email at info@peligoni.com as soon as possible.

5.2 All amendments and cancellations are subject to the relevant amendment and cancellation fees as set out in the Accommodation Terms and the Club Membership Terms, together with the terms of this clause 6.

5.3 While We will endeavour to work with the Property Owner and/or the Peligoni Club to process any amendments, you acknowledge that amendments may not be possible.

5.4 In addition to any amendment fees payable to the relevant supplier, We reserve the right to charge an administration fee of £40 to process any amendment, which You agree to pay.

5.5 ALTERATIONS AND CANCELLATION BY US FOR PACKAGE HOLIDAYS

5.5.1 It is possible that We may have to make changes to Your package holiday (other than the price) as the arrangements are sometimes planned many months in advance. Occasionally changes may be made, and We reserve the right to do so at any time. Most of these changes are insignificant and We will ensure that We advise You as early as possible. Examples of insignificant changes include change of accommodation to another of the same standard or higher standard.

5.5.2 In accordance with applicable regulations, we may unilaterally change the pre-contractual information communicated to You before the booking. In such cases, We will communicate the changes to You in a clear, comprehensible, apparent manner, prior to booking.

5.5.3 We may also make minor changes after the booking. We will then notify You of this in a clear, comprehensible manner through a durable medium.

5.5.4 If a major change becomes necessary and We are constrained by circumstances beyond Our control to significantly alter any of the main characteristics of the services that make up Your package You will have the rights set out below.

5.5.5 We will inform You as soon as reasonably possible if there is time before departure. You will have the choice of either accepting the change of arrangements, accepting an offer of available alternative travel arrangements of comparable standard from Us (where We offer one and We will refund any price difference if the alternative is of a lower value) or cancelling Your holiday and receiving a full refund of all monies paid. We will tell You the procedure for making your choice.  Please read any notification of changes carefully and respond promptly as if You do not response to Us within the timescale given Your booking may be cancelled.

5.5.6 If You choose to accept a refund We will pay compensation as detailed below except where the significant change is due to unavoidable and extraordinary circumstances (as defined below).

5.5.7 We reserve the right to cancel Your booking up to 35 days in advance. In this case We may be able to offer the choice of alternative arrangements of comparable standard, if available (We will refund any price difference if the alternative is of a lower value), or a full refund of all monies paid. We will not cancel less than 35 days before Your scheduled arrival date except for reasons of unavoidable or extraordinary circumstances or your failure to pay the final balance.

5.5.8 If Your holiday is cancelled You can either have a refund of all monies paid or accept an alternative holiday of comparable standard from Us if We offer one (We will refund any price difference if the alternative of is lower value).  In the event a refund is paid to You, we will pay compensation as detailed below except where the cancellation is due to unavoidable and extraordinary circumstances.

5.5.9 If it is necessary to cancel Your holiday (except for reasons of unavoidable and extraordinary circumstances) or make a significant change after the date when payment of the balance becomes due, We will in addition pay You suitable compensation, calculated per person and taking into account the circumstances. Please note compensation is not payable in the case of minor changes. The compensation offered does not exclude You from claiming more if You are entitled to do so.

5.5.10 ‘Unavoidable and extraordinary circumstances’ means a situation beyond Our control, the consequences of which could not have been avoided even if all reasonable measures had been, including (for example) but not limited to, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions, epidemics and pandemics, unavoidable technical problems with transport.

5.6 ALTERATIONS AND CANCELLATIONS BY YOU FOR PACKAGE HOLIDAYS

5.6.1 If, after Our confirmation has been issued, You wish to change to another of Our holidays or modify, at any time, the travel arrangements shown, We will do Our utmost to make the changes provided that notification is received in writing at Our offices from the person who arranged the booking. We reserve the right to charge an administration fee of £40.00 per person in order to process that change, in addition to any further cost in making the alteration. You should be aware that these costs could increase the closer to the departure date that changes are made and You should contact Us as soon as possible. Please note that most of Our travel arrangements may not be changeable after a reservation has been made and any alteration request could incur a cancellation charge of up to 100% of that part of the arrangements.

5.6.2 You, or any member of Your party, may cancel Your holiday at any time provided that notice of the cancellation is made by the person arranging the booking. As most of Our travel arrangements and bookings cannot be changed after confirmation, cancellation incurs cancellation charges and administration costs.  This means that You will not receive a full reimbursement of monies paid to Us, in order to cover these charges and costs.  The amount payable as cancellation charges will depend on the arrangements booked and how close to departure You are from the time at which You give Us notice to cancel, although this may result in a cancellation charge which is 100% of monies paid for arrangements booked.  This will be confirmed to You at the time We receive Your cancellation notice.

5.6.3No refund will be given after the commencement of travel except at Our discretion. Please note that if the reason for Your cancellation is covered under the terms of Your insurance policy then You may be able to reclaim these charges.

5.6.4 You can cancel Your booking without paying cancellation charges if the performance of Your package, is significantly affected by unavoidable and extraordinary circumstances.  In such circumstances, We will arrange for Your booking to be terminated and for You to receive a full refund without any right to additional compensation. We will observe advice provided by the UK Foreign & Commonwealth Office.

5.7 TRANSFER OF YOUR BOOKING FOR A PACKAGE HOLIDAY: For any transfer of Your booking for a package holiday, it is recommended that You ask Us in advance about any potential fees, and if possible, 20 days before the departure date, to give Us time to ask Our suppliers.  You can transfer Your booking to another person, who satisfies all the conditions that apply to this booking, by giving Us notice in writing (by email) at least 7 days before departure.  Both You and the new traveller are responsible for paying all costs We incur in making the transfer including our administrative fees as notified to You at the time of requesting the transfer.

  1. COMPLAINTS AND CONDUCT

6.1 If You have a problem during Your holiday, please inform the relevant supplier (e.g. Your Villa Manager or The Peligoni Club reception team) immediately, who will endeavour to put things right. It is strongly recommended that You communicate any complaint to the supplier of the services in question without delay. The amount of compensation You may be entitled to may be reduced or You may not receive any at all depending upon the circumstances. Any compensation is subject to the relevant Accommodation Terms or the Club Membership Terms and our liability is limited to passing on any compensation We receive from a supplier on account of Your complaint.

Please follow this up within 28 days of Your return home by writing to Us giving Your original reference number and all other relevant information, by writing to Us.  Please keep Your letter concise and provide all relevant information (booking reference,, invoices, proof of undelivered services, etc.),  If You fail to follow the requirement to report Your complaint in resort, We will have been deprived of the opportunity to investigate and rectify it and this may affect Your rights under this booking.

6.2 It is unlikely that You will have a complaint that cannot be settled amicably between Us. However, disputes arising out of or in connection with this contract which cannot be amicably settled, may (if You so wish) be settled by way of an alternative dispute resolution procedure.

6.3 You acknowledge that You are responsible for the proper conduct of all members of Your party during Your holiday, and pursuant to the Accommodation Terms and the Club Membership Terms:

6.3.1 the relevant supplier reserves the right at any time to terminate the holiday of any party member(s) whose behaviour is such, in the reasonable opinion of the supplier, to cause or to be likely to cause danger, upset, harassment or distress to anyone else or damage to other persons or to property;
6.3.2 You will generally not be entitled to any refund in the event of you, or any member or Your party, being requested to cease Your holiday in such circumstances;
6.3.3 We shall be under no obligation whatsoever to pay compensation to You or any member of Your party, or meet any costs or expenses (including but not limited to alternative accommodation) You, or any member of Your party, may incur as a result of Your stay being terminated; and
6.3.4 You must also indemnify Us for the full amount of any claim (including all legal costs) made against Us by the relevant supplier or third party as a result of damage caused by You or a member of Your travelling party.

  1. LIABILITY

7.1 You must inform Us without undue delay of any failure to perform or improper performance of the travel services sold to You by Us.  If any of the travel services We sell to You are not performed in accordance with the contract, or are improperly performed, by the travel service suppliers, and this has affected the enjoyment of Your travel arrangements, then We will seek to make good any damage caused to You (or anyone included in Your booking), in accordance with this clause and in the case of a package holiday, you may be entitled to an appropriate price reduction or compensation, or both.  However, We will not be liable where any failure to perform or improper performance of the travel services is due to You or another member of Your party; or a third party unconnected with the provision of the travel arrangements and whether the failure is unforeseeable or unavoidable; or unavoidable and extraordinary circumstances (as defined above) beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken.

7.2 We accept responsibility for the negligent acts and/or omissions of our employees, agents or suppliers. Save for liabilities under clause 8.3 below, Our liability to You in all cases (except where they lead to death, injury or illness) shall be limited to a maximum of three times the cost of the original travel arrangements.

7.3 Our liability to You will also be limited in accordance with and/or in an identical manner to:

  1. i) the contractual terms of the companies that provide the travel services that make up your package, including the Supplier Terms which are incorporated into this booking; and
  2. ii) any relevant international conventions (for example, the Montreal Convention for travel by air, the Athens Convention for travel by sea, the Berne Convention for travel by rail and the Paris Convention for accommodation), which limit the amount of compensation that You can claim for death, injury, delay to passengers and loss, damage and delay to luggage. We are to be regarded as having all benefit of any limitation of compensation contained in these or any conventions. You can ask for copies of the international conventions, from Us.

7.4 If You, or any member of Your party, suffers death, illness or injury whilst overseas arising out of activity which does not form part of a package holiday organised by Us or excursion or activities arranged through us, We shall at Our discretion, offer advice, guidance and assistance to help in resolving any claim You may have against a third party. Where legal action is contemplated and You want Our assistance You must obtain Our authority prior to commencement of proceedings. Our consent will be given subject to You undertaking to assign any costs, benefits received under any relevant insurance policy to ourselves.

7.5 If You are prevented from enjoying the arrangements booked for You because in the opinion of any person in authority of those travel arrangements You (or a member of Your party) appear, by reason of intoxicating liquor or use of drugs, either to be unfit for use of the services or likely to cause discomfort or disturbance to other passengers, Our responsibility for You ceases. You must accept responsibility for Your proper conduct and that of Your party and We therefore have the right to terminate the contract in circumstances of serious misconduct by You or any member of Your party.

  1. VISAS & HEALTH

8.1 Specific passport and visa requirements, and other immigration requirements are Your responsibility and You should confirm these with the relevant Embassies and/or Consulates. Any information supplied by Us on these or related matters (such as climate, when to travel, clothing, baggage, personal items etc.) is given as general guidance and in good faith but We do not accept liability for any decisions made on the basis of the information supplied.  You should confirm these with the relevant authorities, embassies and/or consulates.

8.2 The passport, visa and health requirements at the time of Booking can be viewed on the Foreign and Commonwealth Office website (fco.gov.uk). It is Your responsibility to ensure that You and all members of Your party are in possession of all necessary travel and health documents, and in compliance with any other immigration requirements, before You travel. If You or any member of Your party is not a British Citizen or holds a non-British Passport, You must check passport and visa requirements with the embassy or consulate of the country(ies) You are travelling to or through. Neither We, nor the supplier(s) of travel services, accept any responsibility and shall not be liable for any loss, expense, costs, damage, injury or loss of enjoyment suffered as a result of such invalidity or loss, including any responsibility if You cannot travel because You have not complied with any passport, visa or immigration requirements.

  1. CUSTOMER ASSISTANCE

9.1     Should You suffer from any serious physical handicaps or experience difficulty in sailing and tire easily, please do bring this to Our attention at the time of booking in order that We can provide the necessary assistance whilst on holiday. The general information on the fact that the services are or are not adapted for persons with reduced mobility is available on the website, or by telephone. On request, specific information about the suitability of the services for Your needs and that of the members of Your party may be provided by telephone.

9.2 If You’re in difficulty whilst on holiday and ask Us to help, We will provide appropriate information on health services, local authorities and consular assistance; and helping You to find alternative arrangements and any necessary phone calls/emails.  You must pay any costs we incur, if the difficulty is Your fault.

  1. INSURANCE

Many suppliers require You to take out travel insurance as a condition of booking with them, which the suppliers of both the accommodation and club membership providers require as a condition of these Booking Conditions. Such policy of insurance should cover You and Your party against the cost of cancellation by You; the cost of assistance (including repatriation) in the event of accident or illness; loss of baggage and money; any activities You or Your party wish to undertake whilst on holiday; and other expenses. 

  1. GENERAL

11.1 (Entire Agreement) These Booking Conditions constitute the entire agreement and understanding between Us and You regarding Your Booking and supersede any and all previous agreements, written or oral, express or implied between Us and You with respect to Your Booking and they may not be modified except by Our and Your written agreement.

11.2 (Severability) If any provision of these Booking Conditions is found by any court or other authority of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force.

11.3 (Governing Law) These Booking Conditions are governed by the laws of England and Wales and the jurisdiction of the English courts.

11.4 (Data Protection Policy) In order to process your booking and to ensure your travel arrangements run smoothly and meet your requirements, we need to use the information you provide to us, such as name, address, contact details and any special needs/dietary requirements. Please see our Privacy Policy for details of how we collect and process your personal data, and the personal data of those in your party.

  1. DEFINITIONS

12.1 In these Booking Conditions, the following terms shall have the meanings set opposite them:

Accommodation means Your accommodation at the Property subject to the Accommodation Terms;
Accommodation Terms means the terms and conditions upon which the Property Owner contracts with You for the provision of the Property, as annexed to these Booking Conditions;
Arrival Date means the means the date on which Your Booking for the Property commences as specified in Your Booking Confirmation, or Your Club Membership begins, whichever is the earlier;
Booking means Your Booking for the Property and any Club Memberships upon the Accommodation Terms and the Club Membership Terms, and as particularised in Your Booking Confirmation;
Booking Confirmation means the booking confirmation for Your Booking issued by Us and which sets out the particulars relating to Your Booking for the Property and any Club Memberships and Club Activities;
Club Activities means any activities pre-purchased by You from the Peligoni Club to be experienced at the Peligoni Club or in its vicinity including without limitation watersports and excursions;
Club Membership Packages means such membership packages to the facility known as the Peligoni Club that may be offered by the  Peligoni Club from time to time;
Club Membership Terms means the terms and conditions upon which the  Peligoni Club contracts with You for the provision of Club Memberships and Club Activities, as annexed to these Booking Conditions;
Departure Date means the date on which Your Booking for the Property ends as specified in Your Booking Confirmation;
Deposit means the deposit(s) payable by You on acceptance of Your Booking as specified in the Booking Confirmation;
(The) Peligoni Club means Peligoni Club M. E.P.E. (ΠΕΛΙΓΟΝΙ ΤΟΥΡΙΣΤΙΚΗ Μ. Ε.Π.Ε. in Greek), a company registered in Greece, Tax office of Zakynthos, under VAT number EL 999519639, whose registered office is at Ag. Nikolaos, Volimes Zakynthos Greece, PC 29 091;

Property means the property specified in the Booking Confirmation;
Property Owner means the person(s) or entity specified in the Booking Confirmation as the owner of the Property; and
Security Deposit means the amount(s) as specified in the Booking Confirmation, which You authorise Us (as agents for the Property Owner and/or the Peligoni Club) to charge to Your credit card (the details of which You are required to provide at check-in at the Peligoni Club) on the Property Owner’s instructions pursuant to the Accommodation Terms and/or the Peligoni Club’s instructions pursuant to the Club Membership Terms.
Working Days a day that is not a Saturday or Sunday, or any day that is a bank holiday in the UK.

ANNEXURE A: ACCOMMODATION BOOKING CONDITIONS

These Accommodation Booking Conditions apply to Your (“You” / “Your”) booking for the Property from the Property Owner specified in Your Booking Confirmation (“We” / “Us” / “Our”). Capitalised terms are defined in the Booking Conditions and in condition 16 of these Accommodation Booking Conditions.

  1. BOOKING PROCESS

1.1 These Accommodation Booking Conditions apply to Your Booking of the Property set out in Your Booking Confirmation.

1.2 We are either the owner of the Property or have the full legal authority from the owner of the Property to enter into an agreement based on these Accommodation Booking Conditions (‘Agreement’) with You on the Property Owner’s behalf.

1.3 Unless otherwise agreed, all Bookings are to be made via Our agent, Peligoni Booking Services Limited (PBS). PBS may require You to complete a booking form or to make Your Booking via the PBS website. Notwithstanding, We are the principal supplier of the Property to You.

1.4 When You make a Booking with Us, You guarantee that You have the authority to accept and do accept on behalf of Your party these Accommodation Booking Conditions.

1.5 Your Booking is for accommodation at the Property only and does not include any other services other than the services connected with the Accommodation as set out in these Accommodation Booking Conditions.

  1. PAYMENTS

2.1 All Bookings are subject to Your payment of the Deposit which is due within forty eight (48) hours of receipt of Your Booking Confirmation. The Deposit is non-refundable other than in circumstances where We cancel Your Booking or make a significant amendment to Your Booking which You do not approve or where You do not accept an alternative property offered by Us.

2.2 The Balance is due by the Balance Due Date.

2.3 All payments are to be made to PBS, who will issue a demand invoice to You for Your Booking on our behalf as our agent. PBS will advise You of the methods of payment they accept.

2.4 If You fail to make a payment by the due date, then You will be deemed to have cancelled Your Booking, and the cancellation charges set out in condition 6.2 will apply.

  1. CHECK-IN AND CHECK-OUT

3.1 The Property will be available for You from 4pm on Your Arrival Date. You are required to check-in at The Peligoni Club, which is operational from 8am until midnight. You will be required to provide a copy of Your passport during check-in. If Your scheduled arrival time changes because of for example a flight delay, You are required to notify PBS as soon as possible.

3.2 You must vacate the Property and check-out at The Peligoni Club by 10am on Your Departure Date. It is important that You depart on time so that Our cleaners can prepare the Property for Our next guests. If You fail to vacate the Property on time, then We reserve the right to deduct an amount equating to a half-day’s rental (or such period of time it takes you to vacate, if longer) from Your Security Deposit.

  1. SECURITY DEPOSIT

4.1 You acknowledge and agree that You are required to provide the Security Deposit as part of the check-in process. The Security Deposit will be taken by PBS as a pre-authorisation.

4.2 Deduction for unacceptable state

4.2.1 A final clean is included in the price of Your Booking. If however You leave the Property in an unreasonable state which requires additional cleaning services over and above what is generally required at the conclusion of a stay at the Property, We reserve the right to make a deduction from the Security Deposit equal to the additional cleaning costs incurred.

4.3    Deduction for damage

4.3.1 Our service providers will undertake a thorough check of the Property after Your departure and prior to Our next guests checking-in. We will advise You as soon as possible of any damage discovered and We will provide photographs where possible.
4.3.2 We understand that accidents happen and We will not make any claims for minor damage or breakages not exceeding €40. We will also consider and disclaim possible maintenance, cumulative wear and tear and any other pre-existing factors that may have contributed to the damage. We will always be reasonable in determining whether to make a deduction to the Security Deposit and We will not make a deduction prior to You having a reasonable time to respond.
4.3.3 If We determine it necessary to make a deduction to the Security Deposit, then We (or Our authorised agent) will only charge Your pre-authorised card (taken on check-in) to the amount required to replace or rectify the damage (on a like-for-like basis), and notwithstanding We will not instruct Our authorised agent to charge Your pre-authorised card for an amount which exceeds the Security Deposit.

4.4 Release of Security Deposit
We will procure that PBS releases the pre-authorisation taken for the Security Deposit within seven (7) Working Days following the conclusion of Your stay, subject always to Our right to instruct PBS to make a charge to Your pre-authorised card or to not destroy or not to release the pre-authorisation pending resolution of a dispute between Us and You pursuant to these Accommodation Booking Conditions.

  1. MAXIMUM OCCUPANCY

5.1 Your travelling party must not exceed the Maximum Occupancy unless We (through PBS) agree otherwise.

5.2 In the event that We discover that Your travelling party exceeds the Maximum Occupancy We reserve the right to charge You twenty percent (20%) of the Booking Value for Your Booking for each additional guest. You consent to Us instructing PBS to charge Your credit card in this regard.

  1. AMENDMENTS AND CANCELLATIONS BY YOU

6.1 If You wish to amend or cancel Your Booking then You are required to notify PBS by email as soon as possible. At our discretion We may permit You to make an amendment to Your Booking, subject to payment of any reasonable amendment charges notified to You. However, We are not obliged to accept any amendments.

6.2 If You cancel Your Booking you will be entitled to a refund, according to the following scale:

6.2.1 More than 12 weeks prior to your arrival date 75% of the total accommodation price will be refunded.
6.2.2 Between 12 and 8 weeks prior to arrival 50% will be refunded.
6.2.3 Between 8 and 4 weeks prior to arrival 25% will be refunded.
6.2.4 Less than 4 weeks prior to arrival no refund will be possible.

  1. AMENDMENTS AND CANCELLATIONS BY US

7.1 You acknowledge that circumstances may arise whereby We are required to cancel or make a significant amendment to Your Booking. This includes but is not limited to serious unforeseen circumstances beyond our control such as fire, flood, major building damage and serious health and safety concerns or risks to Your travelling party.

7.2  In the event that We need to cancel or make a significant amendment to Your Booking, We will notify You as soon as possible. You will have the following options:

7.2.1 request a refund of all monies paid at the time You are notified of the cancellation or significant amendment, which will be paid within 14 days;
7.2.2 request that We arrange an alternative property of the same or higher standard and quality and in the same vicinity to the Property. If We are able to arrange an alternative property at a lower rental, We will refund the difference to You within 14 days of You accepting the alternative property.

7.3 Our liability to You in the event of Us cancelling or significantly amending Your Booking shall in no circumstances exceed the price paid by You to Us at the time that We notify You of the cancellation or significant amendment.

  1. USAGE, NOISE & ANIMALS

8.1 You must not use the Property for any illegal purpose. You must not act in such a way that has the effect of disturbing residents in neighbouring properties.

8.2 Unless otherwise agreed, animals are not permitted in the Property or on the Property grounds. If a member of Your travelling party requires a guide or assistance dog, please advise PBS and We will endeavour to accommodate this.

8.3 Should any guest wish to host a private event at their villa; including parties, wedding ceremonies and/or receptions, drink receptions, pool parties; permission will be required from the Events Team at The Peligoni Club. All private events which are planned to be hosted at a Peligoni villa requires full event management by the in-house Events Team and includes in-house catering, supply of alcoholic & non-alcoholic beverages, staff, set-up & transportation.

  1. BEHAVIOUR AND INDEMNITY

9.1 You acknowledge that We may terminate Your Booking or evict any members of Your party from the Property if the behaviour of Your party or any member of it is in our or our agents’ reasonable opinion is likely to cause danger, upset, harassment or distress to anyone else or damage to other persons or to property.

9.2 In the event that We terminate Your Booking or evict any members of Your party pursuant to condition 9.1:

9.2.1 You will generally not be entitled to any refund;
9.2.2 We shall be under no obligation whatsoever to pay compensation to You or any member of Your party, or meet any costs or expenses (including but not limited to alternative accommodation) You, or any member of Your party, may incur as a result of Your stay being terminated; and
9.2.3 You must also indemnify Us for the full amount of any claim (including all legal costs) made against Us by any third party as a result of damage or injury caused by You or a member of Your travelling party.

  1. PROPERTY ACCESS DURING YOUR STAY AND HOUSE-KEEPING

10.1 You acknowledge that PBS or the Club Operator’s staff or sub-contractors, or maintenance personnel, pool cleaners, or house-keeping staff may access the Property during Your stay to carry out scheduled house-keeping, pool cleaning, property viewings or to carry out any essential maintenance work.

10.2 We will endeavour to keep any inconvenience associated with this access to a minimum.

10.3 A mid-week clean and linen change is included in Your Booking for stays of at least seven (7) nights. No other house- keeping services are provided unless You agree them with Us or We indicate them in marketing material or in Your Booking Confirmation.

  1. COMPLAINTS

11.1 If You have a problem during Your holiday, please contact Your Villa Manager (or in the absence of a Villa Manager, the Club Operator) immediately, who will endeavour to put things right. It is strongly recommended that You communicate any complaint without delay. The amount of compensation You may be entitled to may be reduced or You may not receive any at all depending upon the circumstances.

  1. FORCE MAJEURE

12.1 For the purposes of this condition, “Force Majeure” includes, but is not limited to an act of God or public enemy; war; hostilities; acts of terrorism; risk; fire; flood; natural disasters; storm; civil disturbance; explosion; abnormal or adverse weather conditions; epidemics, pandemics or notifiable diseases; power failure or reduction of power supplies; acts, orders or regulations of any governmental or regulatory authority, agency, department or association; lack or shortage of materials or inability to procure equipment, labour, fuel, power or materials from suppliers.

12.2 In the event that We are prevented from performing Our obligations for an event of Force Majeure, then We shall be entitled to terminate Your Booking and subject to Us refunding to You any Deposit and Balance payments made We shall have no further liability to You.

12.3 Subject to clause 12.2, You acknowledge that You shall not be entitled to any refund if You are not able to make use of Your Booking due to an event of Force Majeure, but where we remain willing and able to accommodate Your Booking.

  1. OUR LIABILITY

13.1 These Accommodation Booking Conditions shall not limit or exclude Our liability for death or personal injury caused by Our negligence.

13.2 Subject to clause 13.1 and to the fullest extent permitted by law:

13.2.1 We shall not have any liability to You (or to any members of Your travelling party or any guests invited to the Property) for any loss, destruction or damage to personal possessions, or any personal injury or death; and
13.2.2 Our maximum liability for all any claims arising out of or in connection with Your Booking at the Property shall be limited to the Booking Value actually paid.
13.2.2 We strongly encourage You and Your travelling party to take out a comprehensive travel insurance policy to insure against cancellations, public liability, personal injury, death and damage or destruction to personal belongings.

  1. OUR AGENTS

14.1 You acknowledge that PBS is not a party to the agreement between You and Us with respect to Your Booking and that PBS is our agent only. In this regard, PBS shall not be responsible for the performance of Our obligations to You.

14.2 You acknowledge that anything We are permitted to do or omit to do under these Accommodation Booking Conditions can be done or omitted to be done by PBS as our agent, provided that PBS has no obligation to You in this regard.

  1. GENERAL
  2. 1 (Entire Agreement) These Accommodation Booking Conditions constitute the entire agreement and understanding between Us and You regarding Your Booking and supersede any and all previous agreements, written or oral, express or implied between Us and You with respect to Your Booking and they may not be modified except by Our and Your written agreement.

15.2 (Severability) If any provision of these Accommodation Booking Conditions is found by any court or other authority of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force.

15.3 (Governing Law) These Accommodation Booking Conditions are governed by the laws of England and Wales and the jurisdiction of the English You may however, choose the law and jurisdiction of Scotland or Northern Ireland if You wish to do so.

  1. DEFINITIONS

In these Accommodation Booking Conditions, the following terms shall have the meanings set opposite them:

Balance means the balance of the Booking Value owing by You following Your payment of any Deposit as may be specified in the Booking Confirmation;
Balance Due Date means the date on which the Balance is due as specified in the Booking Confirmation;
Booking means Your Booking for the Property from the Arrival Date until the Departure Date for the Booking Value, subject to these Accommodation Booking Conditions;
Booking Value means the price for Your Booking for the Property;
Club Operator means the operator of The Peligoni Club;
Villa Manager means any manager appointed by Us to manage the Property as notified to You.

ANNEXURE B: THE PELIGONI CLUB MEMBERSHIP BOOKING CONDITIONS

These Club Membership Booking Conditions apply to Your (“You” / “Your”) booking for the Club Memberships at The Peligoni Club and/or any Club activities from the Peligoni Club M.E.P.E. ( ΠΕΛΙΓΟΝΙ ΤΟΥΡΙΣΤΙΚΗ Μ. Ε.Π.Ε. in Greek), a company registered in Greece, Tax office of Zakynthos, under VAT number EL 999519639, whose registered office is at Ag. Nikolaos, Volimes Zakynthos Greece, PC 29 091 (“We” / “Us” / “Our”). Capitalised terms are defined in the Booking Conditions and in condition 17 of these Club Membership Booking Conditions.

  1. BOOKING PROCESS

1.1 These Club Membership Booking Conditions apply to Your booking for Club Memberships for Your travelling party as set out in Your Booking Confirmation, together with any Club Services that You may wish to purchase prior to your Arrival Date or whilst You are at the Peligoni Club.

1.2 Unless otherwise agreed, all Bookings are to be made via our agent, Peligoni Booking Services Limited (PBS). PBS may require You to complete a booking form or to make Your Booking via the Peligoni website, as notified to You by PBS. Notwithstanding, We are the principal supplier of Club Memberships and any Club Services to You.

1.3 When You make a Booking with Us, You guarantee that You have the authority to accept and do accept on behalf of Your party these Club Membership Booking Conditions.

  1. MEMBERSHIP & CLUB SERVICES

2.1 Your Club Memberships entitles You to the Membership Inclusions for the Membership Period, and subject to these Club Membership Booking Conditions we will use reasonable endeavours to procure that the Membership Inclusions are supplied to You with reasonable skill and care. You acknowledge that Membership Inclusions may be supplied by our suppliers.

2.2 During the booking process or at any time prior to Your Membership Period, You may purchase Club Services. Club Services are subject to availability at the time You make Your request, and if they are not available then this does not give You any right to terminate any Club Memberships.

  1. PRICE & PAYMENT

3.1 The Price for Club Memberships and Club Services is as displayed on the PBS Website on our behalf at the time You request a Booking.

3.2 All Bookings are subject to Your full payment for the required number of memberships known at that time which is due within forty-eight (48) hours of receipt of Your Booking Confirmation.

3.3 All payments are to be made to PBS, who will invoice You on our behalf as our agent. PBS will advise the methods of payment they accept.

3.4 If You fail to make a payment by the due date, then You will be deemed to have cancelled Your Booking, and the cancellation charges set out in condition 8.2 will apply.

3.5 In the event that You cancel after payment has been made, the funds received by Us will be refunded according to the cancellation charges set out in clause 8.2.

  1. SECURITY DEPOSIT & DAMAGE

4.1 You acknowledge and agree that You are required to provide a Security Deposit by way of providing credit card details at the commencement of Your Membership Period at The Peligoni Club.

4.2 We will advise PBS if You (including for the avoidance of doubt any member of your travelling party) damage any equipment or facilities at The Peligoni Club.

4.3 You are responsible for any damage to any equipment or facilities as a result of any member of Your travelling party’s wilful damage, gross negligence, being under the influence of alcohol or drugs, or refusal or failure to obey reasonable instructions given by Us or our staff.

4.4 We understand that accidents happen and will also consider and disclaim possible maintenance, cumulative wear and tear and any other pre-existing factors that may have contributed to the damage.

4.5 We will always be reasonable in determining whether to make a deduction to the Security Deposit and We will not make a deduction prior to You having a reasonable time to respond.

4.6 If We determine it necessary to effectively make a deduction to the Security Deposit, then We will only instruct PBS to charge Your pre-authorised card to the amount required to replace or rectify the damage (on a like-for-like basis), and notwithstanding We will not instruct PBS to charge Your pre-authorised card for an amount which exceeds the Security Deposit. We will never add a mark-up.

4.7 We will procure that PBS releases the pre-authorisation taken for the Security Deposit within seven (7) Working Days following the conclusion of Your Membership Period, subject always to Our right to instruct PBS to make a charge to Your pre-authorised card or to not destroy or not to release the pre-authorisation pending resolution of a dispute between Us and You pursuant to these Club Membership Booking Conditions.

  1. ARRIVAL AND TAB

5.1 When You arrive at The Peligoni Club at the commencement of Your Membership Period:

5.1.1 You are required to provide a copy of Your passport to Us.
5.1.2 All members of Your travelling party are required to attend any safety briefing provided by the Peligoni Club and comply with all terms of use of the Peligoni Club facilities that are provided to You and / or Your travelling party from time to time during Your stay.

5.1.3   Where You are partaking in any Club Services, in addition to the requirements at clause 5.1.2, You and/or any relevant member of Your travelling party must sign any document provided by The Peligoni Club which acknowledges that they have personally attended the safety briefing and understand all instructions and implications of partaking in such Club Services.

5.2 If You would like to open a tab for in-Club Purchases, then We may require You to provide a credit or debit card as security for your in-Club Purchases, as all in-Club Purchases are purchased from Us.

  1. BEHAVIOUR AND SUPERVISION

6.1 You are at all times responsible for the supervision and behaviour of minors and persons under Your control. You acknowledge that the swimming pool and beach are not patrolled.

6.2 You and Your travelling party must not:

6.2.1 operate any equipment if impaired by drugs or alcohol;
6.2.2 comply with the reasonable instructions of Our staff at all times; and
6.2.3 behave in a manner which in Our opinion is likely to cause distress, damage, annoyance, harassment or danger to other members, staff, third parties or damage to property or equipment.

  1. AVAILABILITY OF EQUIPMENT AND BAD WEATHER

7.1 You acknowledge that all Club Services and any relevant equipment is subject to availability and that Your preferred equipment may not be available from time to time.

7.2 Although it is uncommon, adverse weather conditions may result in Club Services being cancelled at short notice in the interests of Your health and safety.   1. AMENDMENTS AND CANCELLATIONS BY YOU

8.1 If You wish to amend or cancel Your Booking then You are required to notify PBS by email as soon as possible. At our discretion We may permit You to make an amendment to Your Booking, subject to payment of any reasonable amendment charges notified to You. However, We are not obliged to accept any amendments.

8.2 If You cancel Your Booking, We will refund your memberships according to the following scale:

8.2.1 More than 12 weeks prior to your arrival date 50% of the total membership price (all except the deposit) will be refunded.
8.2.2 Between 12 and 6 weeks prior to arrival 25% will be refunded.
8.2.3 Less than 6 weeks prior to arrival no refund will be possible.

  1. AMENDMENTS AND CANCELLATIONS BY US

9.1 You acknowledge that circumstances may arise whereby We are required to cancel or make a significant amendment to Your Booking. This includes but is not limited to serious unforeseen circumstances beyond our control such as fire, flood, major building damage and serious health and safety concerns or risks to Your travelling party.

9.2 In the event that We need to cancel or make a significant amendment to Your Booking, We will notify You as soon as possible. We will give You the option to:

9.2.1 request a refund of all monies paid at the time You are notified of the cancellation or significant amendment, which will be paid within twenty-five (25) Working Days; or
9.2.2 accept a different Membership Period if We offer it to You.

9.3 Our liability to You in the event of Us cancelling or significantly amending Your Booking shall in no circumstances exceed the price paid by You to Us at the time that We notify You of the cancellation or significant amendment.

  1. ACCEPTANCE OF RISK, MEDICAL TREATMENT AND TRAVEL INSURANCE

10.1 You must advise Us if any of Your travelling party suffers from a medical condition that could affect their ability to safely participate in activities at The Peligoni Club or which are organised by Us.

10.2 You understand and accept that water sport activities (both motorised and manual), by their very nature, include certain inherent risks that cannot be eliminated regardless of the care taken. The risks include injury and death.

10.3 If you suffer an injury or medical emergency, You consent to Our trained staff giving You first-aid until first medical responders arrive or until You are transferred to a medical facility.

10.4 We strongly encourage You and Your travelling party to take out a comprehensive travel insurance policy to insure against cancellations, public liability, personal injury, death and damage or destruction to personal belongings.

10.5 We shall only be liable to You where we have not provided Our services to You with reasonable skill and care and have been negligent.

  1. TERMINATION OF CLUB MEMBERSHIP AND INDEMNITY

11.1 You acknowledge that We may terminate the Club Memberships of Your travelling party before the end of the Membership Period if any of their behaviour is contrary to the requirements specified in condition 6.2.1 or 6.2.3 or if any of them persistently fail to comply with Our reasonable instructions.

11.2 In the event that We terminate the Club Memberships under condition 11.1:

11.2.1 You will generally not be entitled to any refund;
11.2.2 We shall be under no obligation whatsoever to pay compensation to You as a result of Your Club Membership being terminated; and
11.2.3 You must also indemnify Us for the full amount of any claim (including all legal costs) made against Us by any third party as a result of damage or injury caused by Your travelling party.

11.3 Your Club Membership will automatically terminate at the end of Your Membership Period and your departure.

  1. FORCE MAJEURE

12.1 For the purposes of this condition, “Force Majeure” includes, but is not limited to an act of God or public enemy; war; hostilities; acts of terrorism; risk; fire; flood; natural disasters; storm; civil disturbance; explosion; abnormal or adverse weather conditions; epidemics, pandemics or notifiable diseases; power failure or reduction of power supplies; acts, orders or regulations of any governmental or regulatory authority, agency, department or association; lack or shortage of materials or inability to procure equipment, labour, fuel, power or materials from our suppliers.

12.2 In the event that We are prevented from performing Our obligations for an event of Force Majeure, then We shall be entitled to terminate Your Booking and subject to Us refunding to You any Deposit and Balance payments made We shall have no further liability to You.

12.3 Subject to clause 12.2, You acknowledge that You shall not be entitled to any refund if You are not able to make use of Your Booking due to an event of Force Majeure, but where we remain willing and able to accommodate Your Booking.

  1. PHOTO AND VIDEO RELEASE

13.1 You acknowledge that You may be photographed or filmed at The Peligoni Club by authorised photographers or videographers. Subject to condition 13.2, You consent to Us or our agent PBS using such images or footage in promotional or advertising material in whatever format.

13.2 If You do not want to be photographed or videoed, please advise PBS prior to Your Membership Period and We use our best endeavours to ensure that You are not.

  1. OUR LIABILITY

14.1 These Booking Conditions shall not limit exclude Our liability for death or personal injury caused by Our negligence.

14.2 Subject to clause 14.1 and to the fullest extent permitted by law:

14.2.1 We shall not have any liability to any member of Your travelling party for any loss, destruction or damage to personal possessions, or any personal injury or death; and
14.2.2 Our maximum liability for any claims arising out of or in connection with Your Booking shall be limited to the Booking Value actually paid for your Club Membership.

14.3 You acknowledge that any activities that you undertake at the Club, including (but not limited to Club Services) shall be undertaken by You or any member of Your party at Your or their own risk and You warrant to Us that by participating in such activities, You or the applicable member of Your party is fit and able to undertake such activities.  We shall only be liable to You in respect of such activities where We have been negligent and, subject to clause 14.1 above, any liability we have to You or any member of Your party in respect of such activities shall be limited to the cost of such Club Services paid by You to Us.

  1. OUR AGENTS AND SUPPLIERS

15.1 You acknowledge that PBS is not a party to the agreement between You and Us with respect to Your Booking. PBS is our agent. In this regard, PBS shall be responsible for the performance of Our obligations to You.

15.2 You acknowledge that anything We are permitted to do or omit to do under these Club Membership Booking Conditions can be done or omitted to be done by PBS as our agent, provided that PBS has no obligation to You in this regard.

  1. GENERAL

  1. DEFINITIONS

Booking Value means the price for Your Booking;
Club Services means any services offered by the Peligoni Club for use by You, including, but not limited to, Paddlesports, Watersports, use of bar and restaurant facilities, sailing or boat services., or any other services offered by the Peligoni Club to its members;

In-Club Purchases means any purchases of food and beverage, excursions or any other services from the Local Club Operator during Your Membership Period;
Membership Inclusions means the membership inclusions as specified from time to time on the PBS Website;

Membership Period means the period of validity of Your Club Memberships as specified in Your Booking Confirmation;

Paddlesport means an addition to a Club Membership which permits the use of paddleboards and kayaks;

PBS Website means the website operated by PBS at the domain www.peligoni.com

Watersport means an addition to Your Club Membership which permits the use of sailing and windsurfing in addition to the paddleboards and kayaks.
